**Sales Terms and Conditions**
Please carefully review these sales terms and conditions, as they may have changed since your last visit to our website.
These terms and conditions apply to all sales conducted by Tritan BP ("Tritan BP," "we," "us," or "our"), regardless of whether they occur through our websites (such as https://www.tritanbp.com), purchase orders, phone orders, facsimiles, or any other means. By placing an order, you agree to these terms and conditions. Any other terms or conditions specified in any solicitation, purchase order, confirmation, or other document provided by you will not be considered part of these terms and conditions and will not be binding on Tritan BP. Any such additional terms or conditions are automatically rejected by Tritan BP without further notice. In case of any conflict between these terms and conditions and any document provided by you, these terms and conditions will prevail.
We may update these terms and conditions at our discretion. It is your responsibility to review them for any changes each time you make a purchase. Your continued use of the websites or purchase of products constitutes acceptance of the updated terms and conditions.
**Orders:** By adding products to your cart and completing the checkout process, or by placing an order through a purchase order, signed quote, phone, or fax, you have placed an order with us, subject to product availability. We will confirm receipt of your order by email. Payment information and credit card authorization must accompany your order.
**Payment:** All orders must be paid in full at the time of purchase, including the purchase price and estimated shipping costs. Your credit card will be charged in full when placing an order online, by fax, or by phone. Orders will not be processed until payment is received. Any remaining balances, once shipping charges are finalized, must be paid in full before shipping. We reserve the right to cancel any order at our discretion. While we strive to ensure that products displayed on the websites are available for purchase, there may be occasions when a product you ordered is no longer available. In such cases, we will refund the applicable purchase price.
**Product Descriptions and Pricing:** We aim to provide accurate descriptions and prices for our products. However, we do not guarantee the accuracy or completeness of any information or content on the websites, including prices, product images, specifications, and availability. If a product does not match its description, your sole recourse is to return it unused. The price of an item ordered through the websites is not confirmed until the order is placed, and we reserve the right to revise prices at any time before the order is placed. Despite our efforts to ensure accurate pricing on the website and in other sales and marketing materials, errors may occur. In case of a pricing error, we reserve the right to correct it without prior notice. If the correct price of an item is higher than stated, we may contact you for instructions or cancel your order and inform you accordingly.
**Color Variations:** For full details, refer to our What to Know page. It's recommended to order all panels, whether faux or real wood beams, for your project at the same time. Typically, allow for at least a 10% waste factor. Color variations between orders are normal and within industry standards. Separate orders may not have matching colors since each product is crafted and finished individually. With real wood, expect natural variations in grain, pattern, and color. To avoid potential color matching issues in the future, consider purchasing extra product when placing your order.
**Color Consistency:** We strive to ensure that the colors shown in our product photos accurately represent the actual products. However, monitor or screen variations, depending on their age and color calibration, can affect color perception. Real-world lighting and shadows also impact how colors appear. We highly recommend obtaining samples before placing an order to ensure color accuracy.
** Take Off and Measurements:** Tritan BP will provide a “Take Off” review of blueprints, drawings and etc as a courtesy for quoting purposes only. It is the customer responsibility to verify all measurements. We strongly encourage you to field verify all measurements prior to ordering. Tritan BP cannot be held responsible / liable for any errors or omissions for any Take Off provided for quoting purposes.
**Taxes:** Product prices do not include sales, use, excise, value-added, or other applicable taxes. You are responsible for paying these taxes. We may add these taxes and duties to your order total. Tax exemption requests must be accompanied by valid proof of eligibility.
**No Refunds, Returns, or Cancellations:** All products are made to order, so no returns, refunds, credits, or cancellations are allowed once an order is placed.
**Shipping:** All orders are shipped EXW. Under EXW (Incoterms 2024), ownership transfers upon shipping. Product prices do not include shipping costs, which you are responsible for. Shipping costs are often estimated during checkout. If shipping costs cannot be calculated at the time of order, we will notify you, and payment must be made before shipping. Orders are shipped via common carrier freight, dedicated truckload carrier, or UPS Ground (or similar) at our discretion. Risk of loss and title pass to you upon shipment. Detention or off-loading charges at the destination may be charged. There are no penalties for late deliveries. International orders will incur customs clearance charges and local tariffs, payable by you before shipping. Sample orders within the lower 48 states have a small flat shipping fee. Additional shipping fees and tariffs apply to samples ordered in HI, AK, or outside the USA. Shipping fees apply to all Builder's Kits. Once an order is ready to ship, storage fees may apply at our facilities, calculated at 1% of the total order per day.
**Delivery Timing:** If you need a specific delivery date, please contact our Customer Experience Team to confirm production lead times. We will provide production lead times once your order is paid in full. Please note that listed shipping times are estimates only. Domestic transit times typically range from 2 to 7 business days from the date the order leaves our factory. However, specific delivery dates or time frames cannot be guaranteed for any product or order. For estimated delivery dates, refer to the carrier’s website. We are not liable for lost, misplaced, delayed shipments, or freight damaged during transit by freight carriers.
**Unloading Product:** For business or dock-to-dock freight deliveries, the receiving party must unload the product from the truck using a loading dock or forklift. For residential or non-dock deliveries, the freight company will move the material to the truck's tailgate, but the receiving party is responsible for unloading. The truck driver will not unload the shipment, so necessary equipment such as a forklift or pallet jacks must be provided by the receiving party.
**Lift Gate Delivery:** Lift gate delivery service is available for an extra cost. If a lift gate is needed, notify our Customer Experience Team via email before shipping. Additional charges may apply. Lift gates are only suitable for materials 80” or shorter. This service does not include inside delivery or moving the freight pallet away from the truck's tailgate.
**Limited Access Issues:** Inform us of any potential access issues at your delivery location, such as difficulties for the truck to reach the site. Limited access may affect deliverability, requiring arrangements for a shorter trailer or truck before shipping, which could incur additional charges.
**Storage Fees:** If the carrier is unable to deliver your products, you may be subject to their storage rules and charges. If delivery is postponed at your request, storage charges may apply. Refer to the carrier's rules for more details.
**Additional Accessorial Charges:** Any additional charges not covered at the time of order, such as address changes, limited access fees, re-delivery, and storage fees, are your responsibility unless stated otherwise. Misrepresenting a residential address as a business address will result in any residential charges being your responsibility. Address corrections made by carriers due to misrepresentation will result in a back charge to you.
**Receiving Your Shipment:**
- Shipments must be unloaded and inspected within 30 minutes of arrival due to freight carrier policies.
- You or an authorized adult must inspect the shipment carefully before signing for it.
- If you can't fully inspect the shipment, note "SUBJECT TO INSPECTION" on the delivery receipt.
- In case of damage, follow the instructions in "If Your Shipment Is Damaged."
**If Your Shipment Is Damaged:**
- Inspect the product for damage upon delivery.
- Remove protective wrapping and verify quantities before signing the Delivery Receipt.
- If damaged, reject the shipment or the damaged part and have the driver note it on the receipt.
- The Driver will give you an exception number before signing the delivery receipt. Write DAMAGED on the delivery receipt before signing it.
- Contact us immediately at 866-771-2345 and file a claim directly with the shipping company.
- Photograph the damaged product on the truck and keep all damaged products and packing material for inspection.
- The delivery driver must provide you with an exception number.
- File a claim directly with shipping company for any damage portion of your order.
**Hidden Damage:**
- Notify the shipping company of any hidden damage within 24 hours of delivery to avoid future claim issues.
- Examine the order thoroughly upon delivery and notify us immediately of any damage.
**Examination:**
- You have one business day after arrival to examine the shipment and report any deficiencies in writing.
- Claims will not be recognized after the product has been treated, processed, or changed in any way.
- Refused product, other than damaged items, without an RMA number will not be accepted and will be returned at your expense.
**Return Policy:**
- Custom-made products, such as custom finishes, ceiling beams, faux wood planking, or other specially ordered items, are not eligible for returns, refunds, credits, or cancellations once the order is placed. Standard items can be returned within 30 days of purchase at the customer's expense. A 15% restocking fee applies, and all returns must have an RMA number written on the box. Upon inspection, you will receive a refund minus the restocking fee for items returned in resalable condition.
- Every order is carefully inspected before packaging and shipping.
- Requests for returns due to manufacturing defects or issues covered under our Limited Warranty must be made within 15 days of receipt.
**Note:**
- Products that have been cut or modified cannot be returned or exchanged.
- For damaged shipments, refer to the "If Your Shipment Is Damaged" section above.
**Returning Product:**
1. Contact us to request a return authorization (RMA), which may be granted at our discretion. The RMA is valid for 30 days from the date of issue. The product must be received at our facility within this timeframe for the return to be accepted.
2. Returns without an RMA will be refused, and you will be responsible for any associated fees and shipping charges.
3. Products must be returned in their original packaging with adequate protection. If the original packaging is unavailable, professional packaging using skids and crates may be required.
4. Clearly label the RMA on the outside of the box and include a copy inside the packaging.
5. For authorized returns and exchanges covered under our Limited Warranty, we will arrange for pickup and cover the return shipping costs.
6. The product must be sent to the address provided once the RMA is approved.
7. If the return is due to our error, the product must be in resalable condition for a replacement to be issued upon inspection.
8. Products returned under a warranty claim will be evaluated according to the terms of our Limited Warranty. If approved, a replacement product will be shipped to you.
**REMEDIES and LIMITATION OF LIABILITY:**
For any claim or damage related to a product, our liability is limited, as allowed by law. We are not responsible for any consequential, punitive, special, incidental, or similar damages, such as lost profits, loss of use, loss of time, lost revenues, inconvenience, loss of business opportunities, or damage to goodwill or reputation. These limitations apply regardless of whether such damages were foreseeable or if we were advised of them, arising from the sale, delivery, use, or loss of use of the products sold.
**CARE AND MAINTENANCE**
**INTERIOR CLEANING:** Use a feather duster or a soft cotton cloth to remove dust or cobwebs. Avoid using the harmful cleaning agents and equipment listed below.
**EXTERIOR CLEANING:** Use a garden hose with a low-pressure nozzle to lightly rinse the panels or beams with clean water, starting from the top and working downwards to let dirt wash off. Avoid using the harmful cleaning agents and equipment listed below.
**UV PROTECTION:** Our painted products are coated with Sherwin Williams paint that includes UV inhibitors for protection against the elements. Periodic maintenance may be needed due to normal wear and environmental exposure. Applying a UV topcoat every 3–5 years is recommended to prevent fading. Annually inspect for and touch up areas where paint has worn off.
**EXTERIOR APPLICATIONS:** For exterior use, applying a UV topcoat for added protection is recommended, available at an extra cost. Inspect the product yearly for paint wear and reapply the UV topcoat every 3–5 years.
**DO NOT USE:** Avoid using abrasive cleaners, ammonia, Magic Erasers, bleach, power washers, scrub brushes, or brooms, as these can damage the product.
**DESIGN TEAM SERVICE FEE:** Our Design Team offers consultation services for detailed design plans and layouts for a nominal fee, credited towards your first order of $2,500 or more (excluding samples). We request detailed information about your space and budget to create a custom design that meets your needs.
**FORCE MAJEURE:** We are not liable for events beyond our control, such as Acts of God, labor disputes, severe weather, material shortages, or legal orders. If such events affect our product supply, we reserve the right to reduce or cancel our obligations under this agreement.
**GOVERNING LAW AND VENUE:** Disputes between Tritan BP and customers/users are governed by Florida state laws, with legal actions heard exclusively in Broward County, Florida, excluding the United Nations Convention on Contracts for the International Sale of Goods.

To reduce fading, apply a UV topcoat every 3–5 years based on sun exposure. For proper application, consult your local Sherwin Williams store. Annually inspect your panels and beams for paint wear and touch up as needed to protect against UV damage.
**Exterior Applications:** For added UV protection on exterior products, apply a UV topcoat, available for an additional fee. Some fading may still occur. Inspect and reapply a UV topcoat every 3–5 years.
**DO NOT USE:** Avoid using abrasive cleaners, ammonia-based products, Magic Erasers, abrasive pads, acidic or alkaline cleaners, bleach, power washers, high-pressure nozzles, scrub brushes, or brooms, as they can damage the product.
